SYNOPSIS:  AN ACT to amend Tennessee Code Annotated, Title 55, Chapter 50, Part 3, relative to the issuance of driver licenses.

TEXT: BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF TENNESSEE:

SECTION 1. Tennessee Code Annotated, Section 55-50-322, is amended by adding the following new subsections thereto:

(j) All written examinations administered to applicants for a driver license or intermediate driver license shall be in English.

(k) Persons who present documentation demonstrating that their presence in the United States is authorized by the United States secretary of homeland security shall be allowed to take in Korean, Japanese or Spanish any written examination for a driver license provided for in this chapter.

SECTION 2. Tennessee Code Annotated, Title 55, Chapter 50, Part 3, is amended by adding a new section thereto, as follows:
 
    Section 55-50-3__. The commissioner is authorized to adopt the rules and
regulations, exemptions and policies promulgated by the United States
secretary of homeland security. The department is also authorized to utilize
any verification process to comply with any rules and regulations, exemptions
and policies promulgated by the United States secretary of homeland security.

SECTION 3. This act shall take effect July 1, 2009, the public welfare requiring it.
